Georgia Child Safety Seat Law


Effective Date
July 1, 1996

Who is Covered?
Children aged four or younger riding in a passenger automobile, van, or pickup truck whicle vehicle is in motion on a public road, street, or highway of Georgia.

Requires out-of-state drivers to comply with restraining their children.

Requires car pools to comply with the law

Requires vehicles for hire, except vehicles for Taxi Cabs as defined by Code Section 40-9-101 or Public Transit Vehicles as defined by Code Section 16-5-20, to comply with the law.

The Penalty:
First conviction...fine up to $50. Second or subsequent conviction..fine up to $100. One citation may be written per child unrestrained or improperly restrained.

Provisions:
Every driver who transports a child passenger four years of age or under shall provide for the protection of the child with a federally approved child safety seat. The seat must be installed and used according to the manufacturer's instructions.

Children ages three and four may be secured in a seat safety belt if no safety seat is available.

It is unlawful for any person under the age of 18 to ride in the covered or uncovered bed of a pickup truck on any public road, street, highway or interstate highway in Georgia. The driver in violation is guilty of a misdemeanor.

Exemptions:
The provisions of the law shall not apply when immediate or emergency attention is required for the child's personal needs.
